Assessment of Member State notifications and implementation plans for derogations from Union waste management targets for packaging and municipal waste

Ensuring compliance with the requirements of the WFD, PPWD and LD and the relevant Annexes is to be carried out through a qualitative and quantitative assessment of the implementation plans submitted by the Member States. The implementation plans pursuant to Article 11(3) of the WFD, and Article 6 (a1) of the PPWD are to be assessed for compliance with the conditions of the respective annexes - Annex IVb (WFD) and Annex IV (PPWD).

The tenderer will assist the European Commission (EC) in particular with:

- The development of a methodology to assess Member States notifications and implementation plans according to the legal requirements set in the WFD, PPWD and LD;

- In-depth qualitative and quantitative assessment of Member State notifications and implementation plans, considering inconsistencies/ weaknesses/ uncertainties with the provisions of WFD and PPWD. The assessment covers limited number of MS – up to 12 Member States eligible for a derogation under the WFD and up to 23 Member States under the PPWD;

- Analysis of the information contained in a Member State notification in relation to each legal requirement of the WFD and PPWD;

- The provision of reasoned conclusion on compliance with each of the legal requirements set in WFD and PPWD and the relevant Annexes;

- Subsequent assessment, analysis and reasoned conclusion of revised Member State notification and implementation plan based on points raised by the Commission within the initial notification (in the case of revised notifications and implementation plans submitted to the Commission following its initial Decision);

- The development of a template for the presentation of the assessment reports.
